Filing a Lemon Law Claim

The Lemon Law Process

Consumers have several options for pursuing a resolution to an issue with a vehicle that may be covered under the Lemon Law. These include the following:

  • Informal Resolution – Car dealers and manufacturers are aware of their responsibilities under the law and often will resolve a customer’s issue without resorting to the legal process once they receive a letter from an attorney.
  • Filing a Claim Through the Lemon Law Unit – New Jersey’s Division of Consumer Affairs maintains a Lemon Law Unit through which Lemon Law claims are heard by an Administrative Law Judge (ALJ) in a quasi-judicial setting.
  • Filing a Claim in Superior Court – A consumer that has a claim under New Jersey’s Lemon Law may also file a claim in Superior Court.
  • Lemon Law Arbitration – Some manufacturers offer an arbitration program. Typically, this is usually the least desirable option as you are forced to accept the Auto Manufacture’s arbitrator and forum.

Lemon Law Qualification

In order to file a Lemon Law claim, a consumer must first determine whether the vehicle he or she purchased qualifies. For example, new vehicles must be less than two years old or have been driven for less than 24,000 miles. On the other hand, used vehicles must be within a warranty period that is determined by the vehicle’s mileage at the time of the sale. In addition to vehicle qualifications, consumers must also take certain procedural steps giving the manufacturer the opportunity to resolve the issue.
